CFW bans

I fully support Sony's right to ban people using CFW
On the other hand, it's a stupid move...
Imagine someone on the piracy fence sees their account got banned, well they ain't buying the DLC
Ban the pirates and the cheaters, not the CFW users, god knows you have enough spyware to detect which is which
And you are probably going to try to claim damages from people like me for your stupidity...again
That said also, I believe in the users right to create a PSN alternative

I dont believe they have the legal right to ban anyone for a right that is given to us under the copyright act 1201 section (f) on reverse engineering. There are many laws that i believe are being broken by Sony right now.

I only believe that a company who offers a service should be able to make terms of use for a feature of their product if it is not advertised as an included feature for the product to encourage its sell and if there is competition on the hardware to use instead.

For instance, i believe Facebook has the right to deny its service to people because they are a service provided to people amongst an open market of social networks. There are alternative options and by no means whatsoever do their terms require you to take away your right to use features that are not in their best interest. For instance, there is no term that says you may not use facebook, if you have a myspace because its not in our financial best interest to provide a very popular service to people who would help our competitors. I believe they can impose certain limitations on our freedom of speech, because it would only cause them damage by the negative press and lack of people coming to the service, and leaving. This is a term to protect the consumers and the developers best interest.

Sony is violating the Sherman Antitrust Act by taking away features that are advertised and purchased by consumers behind a closed market to force their best interest and to keep control of the monopoly over their closed system. If they market software within hardware that has conditions on what you do with the hardware and its OS they violate tying laws because they require you to agree to their service to prevent potential competition.

I believe that making a system interoperable is a form of promoting healthy competition amongst the closed system itself.(EX: Cydnia for MacOS). I believe that the ps3 is sold as a computer, a piece of hardware amongst a market of other computers. While the ps3 does have competitors amongst the hardware industry, i do not believe that they have competition within the closed market that is software that runs on the ps3. I believe they prohibit independent game makers from creating games and selling them because they believe that they will potentially harm their best interest.

I believe that the DMCA was made to protect your own private intellectual copyright property. I believe Sony has the right to implement security to protect their intellectual property. I believe they have the right to release updates that patch vulnerabilities to protect their intellectual property. But by no means whatsoever do i believe they can use their rights to protect a monopoly and inhibit healthy competition to a market of ps3 owners.

A pirated game looks just like a backed up game. But sony should have good faith in their costumers, if they expect us to have good faith in them. To be honest i honestly believe that they could implement a back up feature into their console very easily by registering the game id to your psn, and then allowing you to back it up once its registered to only play on a ps3 with your psn.

But nope.

I'm sorry sir but you have unleashed Hell with your opening up of the PS3 and it might just ruin the whole thing for everyone, no-wonder Sony are suing you, I think with things like the following link you can see why you needed action taking against you.

Geo...this is an infringement on your 1st amendment rights regardless of the EULA...you have the right to freedom of expression...play the card you owned the product they sold...that makes it yours and you are free to express yourself the way your religion dictates...if they ask your religion tell the gov. they are now in violation of your religion just for asking...1-4 amendments...run it to the Supreme Court...see how any of them like having a EULA that violates the Consitution ask for a writ of Habeas Corpus...wrongful prosecution. listen to this advice and ask your attorney if you have grounds and when he says maybe...file a counter-suit for defemation...I am going to spam this in all comment boxes hope you take a moment to read it...Raymie

I think CFW users should NOT be banned. My backups are LEGITIMATE. But its much nicer keeping my library of games on the PS3 and using MultiMan than it is having to swap discs etc etc. It's just a preference - & I like it. I 100% agree with the DLC argument though. I bought all the DLC for NFS:HP for example - another £16, I bought Burnout Paradise + All DLC £50 (i cant remember exactly lol) they made. I wish CFW users were not all tarred with the same brush :(

quick Comment to all GEOHOT Hatters!!! Sony is afraid of Hackers!! they attacked GEOHOT cause he was in reach of them, just look at the guy who hacked the PSP DarkAlex, he made CFW for everyone till update 5.00 and called it 5.00M33-6. My point being is DarkAlex didnt live in the the same country so SCEA could never do anything about it! so i believe GEOHOTZ has the fully legal action to jailbreak anything he legally purchased with a recipe in hand.
