Joining the SONY Boycott

As of 4/11/11, I am joining the SONY boycott. I will never purchase another SONY product.

I encourage you to do the same. And if you bought something SONY recently, return it.

Why would you not boycott a company who feels this way about you?

By the way, I'm a bit surprised at the comment that "the terms of the settlement agreement are 'confidential'". Sony posted on their blog that you agreed to a permanent injunction, surely that qualifies as "terms of the settlement"..?

Any way I look at it, I don't mind. It wasn't a waste.

The DAY the PS4 comes out, I'm picking one up JUST to attempt what you started with the PS3. Freedom. I stood idly by for this one, because I'm not the best at hacking consoles, but now Sony has garnered my attention with this. I'll make it a personal goal for PS4 w/CFW if I can.

Sounds like a win for Sony. Now they get no court case to prove their actions wrong. No court case, no case law, no reason to keep Sony from acting like this again.

Of course, you can't talk about it, so we will never know.

Sure, it's nice that it's over and people can move on with their lives... but I just think people expected a bit more of a fight than this.

PS4 Boycott will be upheld by those with proper knowledge. As you all may know Sony will be feeling the repercussions of their decision to litigate for years to come. They have tried to hire advanced independent employees only to have them reject the offer letters because of Geohot. Thank you for trying to challenge the Beast, geo, but in present day reality Goliath usually wins.

I wish you were right. However, the record companies are still here. Their influence on government across the globe is as real as it was a decade ago. I don't see Sony going anywhere either and the next guy who hacks their hardware will probably face the same legal pressures you did.

What do you plan to do with the money that was donated to you to provide a cushion for the legal battle? I hope you will be paying all those people back since you obviously didn't live up to your word. At least from the vague details you are giving out, it sounds like you got a job and fucked the scene in the process. After all terms of a settlement usually don't remain confidential unless one or both of the parties are go under a contract. Your on a permanent injucnction but I doubt you would keep quite just for that. From the news it sounds like you are happy about this, so I'm gonna go out on a limb and say you got a full time or part time job with Sony. I mean hell we all know Sony will never allow official homebrew on the platform, and we all know piracy doesn't have a goddamn thing to do with the lawsuit. That's just Sony's excuse to justify it.

I hope your satisfied, I'm looking forward to hearing an announcement of you refunding every single person's donation because you obviously didn't keep up to your end of the bargain.

Hotz I paid because I thought you were fighting our fight, not just to save your own ass. Its ok it was only £10 but I feel cheated and I feel that you misrepresented yourself in your appeal. Factually thats fraud. I'm kinda putting you and Sony in the same boat now, you know false advertising , getting people to pay for a feature and removing it....etc....

A lot of people will probably criticize George over donations and "losing" in court, but until we hear the terms of the settlement, I don't think you can justify your "hate" against him. He fought for something much bigger than himself, and I feel sorry for people who don't realize it.

I am disappointed to see these proceedings end this way. I was hoping this case would thoroughly confront the notion that a manufacturer can dictates terms of hardware usage to the consumer, and it appears that issue will have to wait.

Why is Apple not going after hackers in the same way? Isn't this a similar issue?

you can still dispute the paypal transaction. he is not a registered charity so you can file a paypal dispute.

I hope he is claiming the money for the donations on his tax return for 2011.

That's considered earned moeny even if people give it too you. IRS will be sure to make him pay it on his taxes. We might see him fighting the IRS next year.

I think everyone needs to stop speculating and commenting until after his follow-up post. Also, to those posting about the donations: regardless of the outcome, it was worth the money to keep him from being a martyr for all the pirates he didn't endorse to begin with. People too quickly forget everything he has done for the hacking scene to begin with and the fact that he has never hid behind anonymity. George, to you I say thanks.

He is most likely joining the sony boycott because he's already been enjoined from possessing sony hardware.

It really shouldn't need to be said, but it seems to me that some people here can't stop and think things through for more than half a second... I'm sure there is far more going on than meets the eye, and am going to wait to see what results.

As for the Sony boycott, most definately, I'll join up. I got a PS3 and a PSP at the request of a friend and I've never seen so much... I don't even know the right word for it... insanity? lies? deceit? I'm sure there's a better term for it, but there's just so much to cover in that one word...

In general in court cases, the settlement agreement is not filed with the court. If a party is bound by an injunction, that would have to be made available on the public docket.

When I pay to watch my favourite team play soccer, I give the club the money and I expect the team to go out there and do their best. I don't care if they get turned over by a bigger, harder playing team as long as they fight to the end. What I HATE to see is them rolling over and giving up before the final whistle. Not only does it make me not want to come back the next week but it also ruins my belief that they care about the people supporting them. Financially and spiritually.

I guess the early bath suited you more. And that picture of you lifting the cup? Not going to happen as I don't think even a Sunday league team would take you with your baggage in tow.

What the fuck have any of you done, have you ever been under immense pressure to make sure hundreds of thousands are happy and have their rights intact. That would be a burden most people would crack under. If he had to settle to make sure he wouldn't lose entirely then he had to fucking settle so let it go. Who the he'll needs a precedent to say yes we own what we buy? I sure as hell don't need a third party or court to tell me "yes you can do what you want with what you buy"... You don't release something, people are pissed. Sony removes OtherOS, people are pissed at YOU. You settle, people are pissed. You fight, people are pissed. You talk, people are pissed. You stay quiet, people are pissed.

The conclusion I have drawn is that PS3 fanboys are just pissed off.

I was hoping this situation would avoid a settlement and go for a ruling by the courts so there'd be some precedent on the books, and some ruling on the legality of the DMCA and hacking your own hardware (and sharing the information to do so). Personal property rights were on the table to be determined in the legal realm. A settlement avoids a ruling, and thus keeps us from knowing our rights with this technology. Copyright is due for another upheaval like the printing press created.

This is likely something the Supreme Court would take as a case if it got appealed to them. They've not ruled on it before.

As an owner of a PS3 and a programmer myself, when Sony filed the lawsuit against you, that was the last straw. I've been boycotting Sony and will continue to do so for as long as they continue to hold their stance. I'm glad you have publicly expressed the same, since I believe that there are too many that do not really understand the truth behind what all this means. Thank you for representing a largely unrepresented group.

I understand that noone lost their rights, I was just pointing out to others that no one can actually take their rights away they can only be given away. It all really comes down to if people believe a third party really has any authority over an I individual... Philosophically I do not believe they do and will never bow down and hand over any rights. As for everything else, I'm annoyed that there is a settlement when the case is a much bigger thing than the Playstation 3 aspect of it. But you're legally bound not to say anything about it(and saying anything could make things much worse). Can you at least let us know if you will at some point be able to speak about what was in the settlement?

I'm curious about what you'll be doing with the donations, but you seem to have a plan for that. I'd vote towards donating them to the EFF, as they'd make sure the money was spent in the spirit it was donated in.

That situation was for me very difficult to live. I could not support one Entire company using his full force to break one man when freedom was at stake. This was an unbearable situation and I felt and still feel utterly disgusted by the method used. Sometimes when claiming you were a fugitive, it looked like a smear campaign. Ugh, people seem so misguided that I just feel compelled to write more about this whole thing:

First of all, Hotz gets sued by Sony. Promises to fight the fight to the end or until he gets a settlement with Sony that allows for an authorized path to homebrew on PS3, OtherOS and an apology from Sony to the scene.

Then, he proceeds to ask for donations. Many people donate to him because of his promise and all the good that would ensue.

Hotz settles with Sony, breaking his promise and letting down all those people who donated to him.

That is the reason why people are so angry at him.

As for the court case itself and why he should NOT have caved in:

It was a civil case, he couldn't have gotten into jail even if he had suffered a complete, and total defeat in court. The worst outcome would be that he would have had to pay quite a large sum of money to Sony, in which the community would most likely have helped simply out of respect for going through the whole thing.

If he had won the case it would have set a very, VERY powerful precedent and enforced general consumer rights in that you are indeed allowed to modify electronics you have legally bought without fear of facing legal difficulties. Also, it would have created a large barrier for these large companies for trying to bully consumers into submission, and would have helped all consumers in general, not just PS3 owners.

Especially the fact that it would have had nationwide (in the US, that is.) effect on consumer rights is the reason why it was so god damn important to go through with the whole thing.

As for the court case if he had settled as per his original promise to the scene:

We would have an authorized way of using homebrew without having to resort to hacks, and we would also be able to enjoy OtherOS. While this is a LOT less important than the precedent I mentioned earlier it would still have benefited atleast the PS3 scene.

The result:

Well, people lost the money they donated to him, he broke his promises, and there is no way of getting the donated money back. Donations are not covered by the credit card company rules and thus cannot be disputed.

Hotz can try to move to China if he wishes to continue hacking, but no one will take him seriously anymore. Or he can release stuff anonymously, but that will still not change anything, the scene has gained absolutely nothing.

Think of what you would be able to do with if you were in his shoes - how far will the donations go towards fighting Sony? Although a little saddened by the news, I'm glad he (most likely) still has both kidneys. If I were him, I'd do the same thing - you guys make it sound like he had a choice...

People here and on are getting their reactions to the settlement going. You said in one of your replies that PS3 owners are always pissed. My question, in regard to the settlement, and what that means for us all in the foreseeable future is this:

A few things:
1: The "leaked" document is just the public part that NEEDS to be public, there is more to the agreement that that filing. Of course the public filing has only things George has to do. It might even even force OtherOS back, which they could spin as positive for them and "totally unrelated to the lawsuit promise" since no one who knows can talk about it.

2: This settlement does not mean everything is over. George can bring a case against Sony, try to organize (another) class action or... I don't know, a lot can happen. He says something is in the works so we'll have to wait and see.
Though if its good news I suspect all those flaming here will switch sides again.

ok, so this isnt exactly what everyone wanted to see, but it not the worst outcome either, and aside from a very small monitary investment what did you have to loose? Nothing, you chose to donate this money. You either support something and someone or you don't. Stop complaining, be glad that hotz can still help us and others with our iOS devices and who knows what else in the future. This was not a declaration that it is illegal for all people to "jailbreak" there game consoles, this was a settlement between hotz and Scea on this INDIVIDUAL case.
Take a breath, enjoy hat you have right now, boycott everything Sony if that makes you feel better.
As for me, I eagerly await more iOS activity (iPad 2 anyone?)

Yo geo, not sure why people are pissed. If you fight with a giant, and you tie, then isn't that a loss for the Giant?

The fact that you still have clothes on your back and your future isn't ruined is reason enough for me to err on the side of victory, since Sony wasn't able to do to you what they did to Lik Sang.

This may not be the "big win" people were hoping for, but if I'm picking up what you're putting down, I'm anticipating some big wins in the future. :)

what ever happened..i am happy for geohot that this settelment has ended even if sony wins but i still respect geohot..there might be some threat given to geohot by sony..afterall he have his life..he have family..talking for you is very easy for you people but what geohot have gone through is really tough and depressing when sony rades your house and all..

Not a PS3 of any sony product in my house either. Geo, you've done a great job! A great job at the iPhone scene, great job at the PS3 scene. Here in holland (that's why the english is a bit bad), almost anyone i know (owning a iPhone) is enjoying your creative work (so called, jailbreak).

Those troll's who are complaining about their donation... I guess only 5% of them realy donated money to you... thats the magic of anonymous on the internet i guess.

I did read 'some PDF file' which said someting about 10.000 per wrongdoing... a cap of 250.000... hmmm i'm very curious how big the donation bank account is, but i thing people need to keep donating... because... What if you reached the 250.000 cap... ahh, just some wild thinking...

I like how a bunch of these people all flock to see what Geo Hotz did when he released his findings. I also like that people stood up for him when he was fighting Sony, and wish I could have donated. What I find laughable is all of these people that are bashing George for settling with Sony. How about you guys try to take on a huge company like Sony sometime. 9 out of 10 would settle just like George. He is right for not talking about the terms, because he legally has to do so. I will keep coming to this website for updates on whatever George posts, weather it be Ipad , Super Nintendo or something completely different.
